1. Acceptance of Terms
By registering a business account on FyndIt ("the Platform"), you ("the Business" or "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you may not register or use the Platform. These Terms constitute a binding legal agreement between you and FyndIt (Pty) Ltd ("we", "us", or "FyndIt").
2. Eligibility
You must be at least 18 years old and legally authorised to represent the business you are registering. By creating an account, you confirm that all information provided is accurate, complete, and truthful. FyndIt reserves the right to refuse registration at its discretion.
3. Business Listings
You are solely responsible for the content of your business profile, including descriptions, pricing, photos, and contact details. Content must be accurate, lawful, and not misleading. FyndIt does not endorse or verify the quality of work performed by listed businesses unless a Verified badge has been awarded following our verification process.
4. Verified Status
A "Verified" badge may be awarded after FyndIt has reviewed your ID documentation and relevant credentials. Verified status does not constitute an endorsement of your services and may be revoked at any time if documentation is found to be invalid or if conduct breaches these Terms.
5. Subscriptions & Payments
FyndIt offers a free 60-day trial period upon registration. After the trial, continued listing visibility requires an active paid subscription (Bronze, Silver, or Gold tier). Subscription fees are billed in advance on a monthly or annual basis. All fees are stated in South African Rands (ZAR) and are non-refundable unless otherwise required by the Consumer Protection Act 68 of 2008.
FyndIt reserves the right to change pricing with 30 days' written notice. Failure to pay may result in suspension or removal of your listing.
6. Prohibited Conduct
You agree not to:
- Post false, misleading, or fraudulent information;
- Misrepresent your qualifications, credentials, or business identity;
- Use the Platform for any unlawful purpose;
- Harass, abuse, or harm Fynders or other businesses on the Platform;
- Attempt to circumvent the Platform by soliciting direct off-platform payments to avoid fees;
- Upload viruses, malicious code, or attempt to interfere with Platform security.
7. Fynder Enquiries
When a Fynder contacts you through the Platform, you agree to respond professionally and within a reasonable time. FyndIt is not a party to any agreement formed between a Business and a Fynder and accepts no liability for disputes arising from such agreements.
8. Intellectual Property
All content, branding, logos, and software on the Platform are the property of FyndIt (Pty) Ltd and are protected by South African copyright law. You retain ownership of content you upload but grant FyndIt a non-exclusive, royalty-free licence to display that content on the Platform for the purposes of operating the service.
9. Privacy
Your use of the Platform is also governed by our Privacy Policy, which forms part of these Terms. By accepting these Terms, you confirm that you have read and understood our Privacy Policy.
10. Suspension & Termination
FyndIt may suspend or terminate your account at any time, with or without notice, for breach of these Terms, fraudulent activity, or at our sole discretion. Upon termination, your listing will be removed from the Platform. You may also delete your account at any time by contacting us at hello@fyndit.online or +27 (0)79 211 2550.
11. Limitation of Liability
To the maximum extent permitted by applicable South African law, FyndIt shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Platform. FyndIt's total liability shall not exceed the subscription fees paid by you in the three (3) months preceding the claim.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.
13. Changes to These Terms
FyndIt may update these Terms from time to time. We will notify you of material changes via email or a notice on the Platform. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
